Net Neutrality: will the Internet still be free?

The term “net neutrality” has been buzzing around the internet recently. The Internet has become such an integral part of our lives, it’s hard to imagine NOT having the free the easy access to information, video, social networking, and the multiple points of view that the Internet provides. But a terrifying new development seems to be emerging that could spell the end of the “free internet” as we know it.

Net neutrality means that if a publisher and reader pay for their connections, they should have free access to the internet service they have paid for. In other words, certain users should not be charged more than others. Lawrence Lessig, professor of Law at Stanford University has been warning of a time when major telecoms like Comcast would seek to interfere with that connection, paving the way for a corporate take-over of the internet. This is exactly what happened with radio in the early 20th century. Radio in the US used to be a many to many network. Then the “network” was reduced to the few players — NBC, ABC, and CBS — who could afford the new, high prices of radio transmission. A new film “Humanity Lobotomy” documents this trend.

Almost as if on cue, Comcast announced this month its plan to “throttle” service to certain heavier users — a strategic first step that could start a trend of small publishers closing their operations due to high costs. Their clever PR spin is to make it sound like they are penalizing people for “slowing down” the internet. Fortunately, the FCC acted quickly, ordering Comcast to cease all plans for intentionally interfering with the connections of specific users. But the threat remains and a battle may ensue between the public interest and the interests of corporations who would profit from pivatizing access to the Internet.

2008 WTO Meetings Collapse!

The ‘Doha Round’ WTO expansion push was again defeated when a WTO summit in Geneva collapsed in acrimony on July 27, 2008. Attempts by a bloc of multinational corporations and allied governments to expand the WTO have failed since the high profile 1999 Seattle WTO ministerial. The demise of the latest Geneva WTO summit was a victory for small farmers, workers, civil society and developing nations.

One of the first countries to drop out was the Philippine government which served notice to walk away from Doha negotiations after hundreds of farmers, fishers and workers staged back-to-back pickets on July 24 to highlight to the government public opposition to the Doha Round. In front of the Department of Trade and Industry and the office of the National Economic and Development Authority the protestors delivered a special order from the people of the Philippines to defend the interests of poor Filipinos in the WTO negotiations. They reiterated their demand to the President to issue the marching orders to negotiators to walk away from an unfair and unjust Doha deal.

The WTO’s 14-year lifespan has sparked a dramatic wave of popular protest across the world, and this week’s talks were no different, with small farmers, fishers and workers protesting in various national capitals and teams of civil society activists traveling to Geneva to remind their countries’ WTO delegates of the political consequences at home of damaging compromises.

The proposal under consideration would have exacerbated the serious economic, food security and social problems now rocking numerous countries. Although the negotiations are formally dubbed the ‘Doha Round” WTO talks, they include many of the same items as the ‘Millenium Round’ WTO expansion proposed at the WTO Seattle summit that collapsed as protestors took to the streets and developing country negotiators stomped out of the negotiating suites over an agenda viewed as a threat to hundreds of millions of people.

The unwillingness of many countries to concede on particular themes was the proximate cause for the Geneva summit’s collapse, but government positions were based on strong public opposition in many poor and rich nations alike to expanding WTO scope and authority after more than a decade of experience of the WTO’s damaging outcomes.

Seven years of virtual deadlock since the Doha Round WTO expansion talks started signals that most WTO countries and their populations are seeking a different direction than what was offered with the Doha agenda. The WTO Secretariat and the small bloc of mainly rich country governments who stubbornly insist on continuing with the Doha WTO expansion agenda after it has been repeatedly rejected are the ones to blame for the repeated summit collapses and deadlocks. With the damaging socio-economic consequences of WTO implementation and an exclusive negotiating process at the summit having once again translated into a rejection of WTO expansion, the organization’s already-shaky legitimacy is nearing rock bottom.

Acknowledging the broad opposition among WTO member countries to aspects of the Doha Round agenda, WTO officials had called last week’s invitation-only mini-ministerial with the intention of allowing 35 of the WTO’s 153-member nations to participate in a selective process known as the “Green Room”. But even this exclusive process was abandoned by the third day of talks in favor of closed-door meetings among representatives from seven large countries. This so-called “G-7″ group completely excluded African and Caribbean countries, included only Japan and China from all of Asia and only Brazil from all of Latin America.

And this was the so-called Doha “Development” Round! The remaining trade ministers - mainly from poor countries - were left “in the dark sitting in the dark”, as the Indonesian trade minister complained. Kenya’s Deputy Prime Minister and Commerce Minister Uhuru Kenyatta spoke for the African countries in expressing similar anger. The seven large nations announced a tentative deal this weekend, warning that it represented a non-negotiable balance of interests. They declared to the press that a ministerial declaration resolving various issues was at hand. However, when this take-it-or-leave-it deal was brought back to the exclusive 35-country grouping, inquires began about the details. Over the past two days it became clear that the proposed modalities agreement was unacceptable to blocs of countries and the 8-day summit ended where it began: with countries in deep disagreement about the future direction of global trade rules and negotiations.

The TRADE Act: Trade Reform Accountability, Development and Employment Act of 2008

After years of fighting against expansion of the failed NAFTA/WTO model, new trade legislation has been introduced that would fix WTO and NAFTA and set us off on a new direction on trade and globalization policy.

This is a tool activists have been waiting for: all of our protests and the terrible results of agreements like WTO and NAFTA have created a real broad based public demand for change. To translate this desire into action, we have to create a majority for change in Congress. That is because Congress controls U.S. trades and globalization policy. If we want a new policy, we have to build the pressure to make Congress take action.

And sometimes the most effective form of activism is reminding each of our Representatives and Senators that they work for us! Power concedes nothing without a demand. It never did and it never will. The corporations who cooked up WTO and NAFTA are pushing our members of Congress to do the wrong thing on trade and globalization - more of the same. U.S. trade policy is made by Congress.

The legislation has scores of cosponsors. For a bill to get a vote, it must have a long list of such cosponsors. That is where we come in. The prominence of the trade issue in the presidential primary race has created new political demand for real change. We must take action now to shape the future debate. So what’s in the TRADE act that fixes WTO and NAFTA?

The TRADE Act requires a review of existing trade pacts, including NAFTA, the WTO and other major pacts, and sets forth what must and must not be included in future trade pacts. It also provides for the renegotiation of existing trade agreements like WTO and NAFTA. It lays out the key elements of a new trade negotiating and approval mechanism to replace Fast Track - the antidemocratic process that got us into WTO and NAFTA - that would give Congress and the public a steering wheel and emergency brake to make sure future deals are something that could enjoy broad support among the American public.

One of our nation’s greatest challenges is to create new rules for globalization that ensure economic security and the creation of quality jobs here, while offering opportunities for sustainable development in poor countries. Such rules would counter rising income inequality and the threats our current policies pose to national security, our shared global environment, public health and safety, and democratic accountability.

The TRADE Act sets forth the food and product safety, environmental and labor standards; federalism protections; agriculture rules; national security exceptions; and currency anti-manipulation and trade remedy rules that must be included in all American trade pacts. And, because WTO-NAFTA-model trade agreements extend far beyond traditional trade matters, this section also lists what cannot be included in future American trade agreements, including service sector privatization and deregulation requirements; bans on Buy American and anti-sweat shop or environmental procurement policies; new rights and privileges for foreign investors to promote offshoring and expose domestic health and environmental laws to attacks in foreign tribunals; and special protections for Big Pharmacy to limit affordable access of generic medicines.

Who Controls the World…

Less than two weeks after the FISA amendment was passed by Congress, granting retroactive immunity to telecoms who delivered private consumer data to the US government in a seeming violation of the 4th amendment, it’s been learned that AT&T will be emblazoned on every delegate’s bag at the Democratic National Convention. There are other major corporate sponsors to be sure — Comcast, Motorola, Coca Cola, Google and a host of others — but no other logo will have as ominous a presence as that swirly blue globe. According to Democracy Now, the telecom giant has donated over a million dollars to the DNC in return for prominent display space and access to elected officials. But none of these companies have fully disclosed their projected contributions to the convention, according to a new report from the Campaign Finance Institute.

According to Stephen Weissman, Associate Director of the Campaign Finance Institute, the big corporations are in a sense sheltering enormous contributions to the political party via a loophole which allows them to give money to the convention. As he states:

“It’s totally prohibited to give unlimited contributions to political parties. It’s totally prohibited for a corporation or a union to just go right into its treasury and give money to political parties. Yet, under an exemption that was created by the Federal Election Commission, which essentially is made up of representatives of the two major parties, all of this money can be given if it’s given through a host committee under the pretense that it’s merely to promote the convention city.”

Political blogger Glenn Greenwald coined the 2008 Democratic Convention the “AT & T Convention,” indicating that the AT & T logo is prominently displayed on all the bags given to the delegates in addition to television and online placement of the logo. He calls this a “tawdry display” of the inappropriate intimacy between telecom corporations and the US government, given the recent FISA bill. As Greenwald states:

“…none of that would have happened had the Democratic leadership in the Congress, led by Jay Rockefeller in the Senate and Steny Hoyer, the House Majority Leader, the Democratic House Majority Leader in the House, not gotten together and negotiated a bill that immunized the entire telecom industry for any crimes that they have committed or any violations of the privacy rights of their customers for allowing government spying on their customers without warrants.”

Lawrence Lessig, professor of Law at Stanford University and founder of the Center for Internet and Society gave a keynote at this year’s Netroots Conference, outing Speaker of the House Nancy Pelosi who accepted a check for $114,000 from telecom lobbyists shortly before reversing her position on the FISA ammendment, which now provides retroactive immunity to Telecom companies who have provided private consumer data to government officials. The approval ratings of both Pelosi and Obama dropped significantly after the FISA amendment passed, indicating just how serious Americans take the issue of privacy.

Lessig has quoted the astonishing fact that 91% of the US population believes that Capitol Hill is corrupt, placing the public good behind the interests of large corporations. This is the lowest approval rating of the US government by US citizens in history. Reform is needed. Laws were put in place long ago to prevent the infiltration of money into the decision-making process of our elected leaders, leaders whose generous salaries are paid by taxpayer’s dollars. But those regulations have eroded in the past 2 decades and there seems to be an epidemic of corruption. Lessig recently launched a new organization called Change Congress, which asks lawmakers to pledge that they will not take lobbyist financing.
